
The Independent Medical Examination Association (IMEA) has been working on physicians' behalf to keep independent medical exams from being overly regulated by the state. We worked diligently to lessen the impact of Senate Bill 311 in 2005, which would have drastically changed the way IMEs are conducted and which physicians are qualified and allowed to conduct exams. In essence, the IMEA was instrumental in guiding the direction taken by the Workers' Compensation Department to implement the bill's provisions via administrative rule.
During the 2007 legislative session, the IMEA introduced and passed HB 2943 which requires the Director of the Worker's Compensation Department to adopt a standard of conduct that is consistent with the IMEA's Code of Conduct. We are pleased to report that the Workers' Compensation Department took our entire code of conduct and adopted it without any changes.
The Department is continuing to work on guidelines that allow for sanctions and decertification of physicians who violate the requirements of Oregon's statutes. It is imperative that we maintain our involvement and provide our input into the legislative and rulemaking process.
